Research has shown the need to gravitate everyday social disputes towards Alternative Dispute Resolution (ADR) processes. These processes and techniques, particularly Mediation, are more collaborative processes that employ flexible and culturally sensitive problem-solving techniques.
Lord Diplock in Bremer v. South India Shipping Corp, Ltd remarked that “every civilised system of government requires that the State makes available to all its citizens a means for the just and peaceful settlement of disputes between them.”
The Nigerian Justice System for example like so many other jurisdictions in Africa has its shortcomings highlighted by several scholars. Their primary concerns included delay, inadequate infrastructure, court congestion, apparent and perceived corruption, case backlog, insufficient judicial officers and high cost of litigation.
Alternative Dispute Resolution processes such as mediation and expert conflict resolution have existed in many African societies including Nigeria before the introduction and adoption of the Western concept of litigation. The promotion and integration of ADR in some Court systems across the continent has encouraged the growth of ADR.
Notwithstanding the integration of ADR in the Court system, the total closure of the entire Court structure for a long period in 2020 due to the Covid-19 Pandemic has had a devastating effect on access to justice
